Terms & Conditions
Welcome to Afterlight (“Afterlight,” “we,” “us,” “our”). These Terms & Conditions (“Terms”) govern access to our website, afterlight.in (the “Site”) and the engagement of our styling-led creative services. By confirming a project or engaging our services, you agree to be bound by these Terms.
1. SERVICES
Afterlight is a service-only creative studio offering styling, creative direction, photography, videography, and related production services on a project or retainer basis.
All deliverables, timelines, usage rights, and fees will be defined in a written proposal, estimate, or agreement shared prior to commencement. Any change in scope will be quoted separately and must be approved in writing.
2. PROJECT CONFIRMATION
A project is considered confirmed only upon:
- Written confirmation via email or WhatsApp, and
- Receipt of the agreed advance payment
Written communication via WhatsApp shall be deemed valid and legally binding for confirmations, approvals, and project-related instructions.
Once confirmed, project dates, team, and resources are reserved exclusively for the client.
3. FEES, ADVANCE & PAYMENTS
- All fees are quoted in Indian Rupees (INR) unless stated otherwise.
- An advance is required to secure project dates and resources.
- The advance amount is strictly non-refundable under all circumstances, including cancellation or rescheduling by the client.
- The remaining balance must be paid as per the agreed schedule or invoice terms.
- Late payments may result in delayed deliveries, suspension of services, or withholding of final assets.
- Applicable taxes, including GST (if applicable), shall be charged additionally.
4. CANCELLATION & RESCHEDULING
- All cancellations or rescheduling requests must be communicated in writing (email or WhatsApp).
- In the event of cancellation, the advance shall be retained by Afterlight in full.
- Any expenses already incurred on behalf of the client, including but not limited to props, ingredients, materials, talent, locations, logistics, rentals, or third-party services, shall be payable in full.
- Rescheduling is subject to availability and may attract additional charges.
5. CLIENT RESPONSIBILITIES
The client agrees to:
- Provide accurate briefs, references, and approvals on time
- Ensure availability, quality, and condition of products, ingredients, or materials
- Secure necessary permissions, licenses, or location approvals unless otherwise agreed
Delays caused due to late inputs or approvals may impact timelines and costs and shall not be grounds for refunds or fee reductions.
6. INTELLECTUAL PROPERTY & USAGE
Unless otherwise agreed in writing:
- Afterlight retains ownership of all creative concepts, styling, visual direction, and raw content produced.
- Final deliverables are licensed to the client strictly for the agreed usage, medium, territory, and duration.
- Any additional, extended, or commercial usage beyond the agreed scope requires prior written approval and may incur additional fees.
Afterlight reserves the right to showcase completed work for portfolio, website, awards, and promotional purposes unless restricted by a written confidentiality or exclusivity agreement.
7. THIRD-PARTY COLLABORATIONS
Afterlight may engage photographers, videographers, assistants, stylists, or vendors as required. While collaborators are carefully curated, Afterlight is not liable for delays or failures arising from third-party services beyond reasonable control.
8. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
- Afterlight shall not be liable for any indirect, incidental, special, or consequential damages.
- Total liability, if any, shall be limited to the fees paid by the client for the specific project giving rise to the claim.
9. FORCE MAJEURE
Afterlight shall not be held liable for delays or failure to perform due to events beyond reasonable control, including but not limited to natural disasters, government restrictions, illness, equipment failure, or acts of God.
10. WEBSITE & BRAND CONTENT
All content on this Site including text, imagery, branding, and design is the intellectual property of Afterlight and may not be copied, reproduced, or used without prior written consent.
11. CONFIDENTIALITY
Both parties agree to maintain the confidentiality of any proprietary, commercial, or sensitive information shared during the course of a project, unless disclosure is required by law or expressly agreed in writing.
12. TERMINATION
Afterlight reserves the right to suspend or terminate services if payment obligations are not met or these Terms are breached. All outstanding fees and incurred expenses shall remain payable upon termination.
13. GOVERNING LAW & JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of India.
The courts of Bengaluru, Karnataka shall have exclusive jurisdiction.
14. UPDATES TO TERMS
Afterlight reserves the right to modify or update these Terms at any time. Continued engagement of services shall constitute acceptance of the revised Terms.
